Examining the Mandatory Impermissibility of Acquisition Through Drug Trafficking from the Perspective of Imāmiyyah Jurisprudence

Abstract

Drug trade, from production to consumption, is considered the most profitable and largest illegal business in the world. Drugs have acquired characteristics in the last half century due to diversity, expanse, addiction, big business environment and harmful social effects, which can be considered as one of the new topics (Mustaḥdathah) and one may practice ijtihad to deduce their ruling. One of the important issues related to drugs is the issue of earning money through drug trafficking. In this article, in order to determine the mandatory sentence of acquisition through drug trafficking, after introducing the types of drugs and the effects and harms of each, we are forced to extract the mandatory ruling on the use and consumption of drugs from jurisprudential sources and then state the reasons for the sanctity of earning income through drug trafficking. This article deals with the subject in an analytical way and has answered the problem in an Ijtihadi way. The important research findings are that new drugs are extremely harmful and the use of drugs is forbidden because of many personal and social harms; and health and treatment uses are unimaginable for them either. Therefore, anything that is an example of drug use is definitely haram.
